SAUNA USE WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK

INHERENT RISKS
I understand and acknowledge that the use of sauna facilities involves inherent risks, including but not limited to dehydration, dizziness, fainting, overheating, burns, cardiovascular stress, respiratory issues, and other physical injuries. I understand that these risks may be increased by pre-existing medical conditions, including heart conditions, high or low blood pressure, respiratory conditions, or use of alcohol, drugs, or medications.
HEALTH ACKNOWLEDGMENT
I understand that it is my responsibility to consult with a physician prior to using the sauna. I agree to refrain from use if I feel unwell or have been advised not to use the sauna. I agree to follow all posted rules, instructions, age requirements, and occupancy limits.
PREGNANCY ACKNOWLEDGMENT
I acknowledge and agree that I will not enter or use the sauna facilities if I am pregnant or believe I may be pregnant, and I understand that sauna use during pregnancy may pose serious health risks.
ASSUMPTION OF RISK
I voluntarily choose to use the sauna facilities provided by Ogden Valley Sauna LLC dba Huntsville Sauna (“Company”). I knowingly assume all risks, both known and unknown, including the risk of serious injury, illness, or death, whether caused by my own actions, the actions of others, environmental conditions, shared use of the facilities, or the ordinary negligence of the Company, to the fullest extent permitted by law.
USE RULES & CONDITIONS
NO SUPERVISION / SELF-GUIDED USE
I understand that the sauna experience is self-guided and unsupervised and that Company staff are not monitoring individual sessions, providing medical advice, or supervising conduct. The sauna does not include a way for you to contact us while you are inside.
SHARED SPACE ACKNOWLEDGMENT
I understand that the facility is a shared space and that others may use the sauna at the same time. I agree to remain appropriately dressed while on the premises, wearing a swimsuit or other sauna-appropriate attire at all times. I understand that disruptive or inappropriate behavior may result in removal from the premises and/or refusal of future services. I assume the risk of exposure to communicable illness and understand that the Company is not responsible for the conduct of other participants.
AGE REQUIREMENTS
I must be at least eighteen (18) to use the sauna independently. Minors ages twelve (12) through seventeen (17) may use the sauna only when accompanied and closely supervised at all times by a parent or legal guardian. Children under twelve (12) may not use the sauna.
If I am the parent or legal guardian of a participating minor, I consent, agree to supervise at all times, assume responsibility for the risks associated with the minor’s participation, and agree to indemnify and hold harmless the Company from claims arising out of the minor’s use, to the fullest extent permitted by law.
OCCUPANCY AND ACCESS LIMITS
I may only allow entry for the number of individuals included in my reservation. I will not share my access code or allow unauthorized guests. I understand that I am permitted to be on the premises only during my scheduled session time and only during posted operating hours. Arriving early, staying late, or remaining on the property outside of those times is not allowed. I understand that violations may result in removal without refund and may result in additional charges.
RIGHT TO REFUSE SERVICE
I understand that the sauna facility is private property and is not a place of public accommodation open to the general public. Access is limited to registered guests with valid reservations.
The Company reserves the right, in its sole reasonable discretion, to refuse service, cancel a reservation, or require any guest to leave the premises for safety, rule violations, disruptive behavior, damage to property, intoxication, or other conduct the Company believes creates risk to persons or property.
Any refusal of service will be applied in a manner consistent with applicable law and will not be based on race, color, national origin, religion, sex, disability, or any other protected characteristic.
PROHIBITED ITEMS AND SUBSTANCES
No alcohol, drugs, or smoking/vaping are permitted on site. Guests who are under the influence, or who violate this policy, may be denied entry or removed without refund. No food or beverages are allowed in the sauna or facility except water. Violations may result in additional cleaning or damage charges.
SANITATION DISCLAIMER
Bodily fluids, including blood, urine, seminal fluid, and feces, pose health risks. Clients are strictly prohibited from releasing or exchanging any bodily fluids in the sauna or surrounding areas. Violation of this policy may result in a cleaning fee (currently $1,000) and denial of access to the facilities or services.
METAL ITEMS WARNING
I understand that the sauna gets very hot and metal objects can cause burns. I will remove all metal items before entering, including but not limited to jewelry, belts, watches, phones, and metal water bottles. I accept full responsibility for any injury or damage if I fail to do so.
ANIMALS AND HEATED AREAS
For the health and safety of guests and animals, I understand that the sauna room and heated areas reach temperatures that are unsafe and potentially life-threatening for animals.
Animals, including pets and service animals, are not permitted inside the sauna room or any heated area due to the risk of injury and heat exposure.
I acknowledge that if I arrive with an animal, I am responsible for arranging safe care for the animal outside of the sauna room. Where reasonable and feasible, accommodations may be considered in non-heated areas.
EQUIPMENT AND FACILITY CONDITION
SLIPS, TRIPS, AND PHYSICAL HAZARDS
I understand that water may be present on the floors inside and around the sauna, changing areas, and entryways, and that these surfaces may become slippery. I understand that outdoor walkways may also be hazardous, particularly when wet from rain or icy during winter. I also understand that benches, steps, low ceilings, and other fixed structures may create a risk of bumping, tripping, or losing balance when entering, exiting, or moving inside the sauna. I agree to move slowly, use handrails where available, and remain aware of my surroundings. I knowingly assume the risk of slips, trips, falls, and accidental contact with fixed structures, to the extent permitted by law.
STAIRS, ACCESS LIMITATIONS, AND PERSONAL RESPONSIBILITY
I understand that there are stairs leading into the sauna and that steps and elevated surfaces may be present inside the facility and sauna. Access may be difficult or unavailable for individuals with mobility limitations, balance issues, or assistive devices.
I am responsible for determining whether I can safely enter, exit, and use the sauna. I assume all risks associated with navigating stairs, steps, and changes in elevation.
FACILITY CONDITION
I understand that the premises are provided “as is” and that the Company may make ongoing adjustments, improvements, or changes to the facilities. I acknowledge that features, amenities, and layouts may vary over time, and the Company does not guarantee that the premises will remain exactly the same.
PERSONAL BELONGINGS
I understand that I am responsible for my own personal property. The Company is not responsible for loss, theft, or damage to any personal items brought onto the premises, including items left in vehicles, changing areas, or the sauna. I agree not to bring valuables and do so at my own risk.
LEGAL TERMS
RELEASE OF LIABILITY AND WAIVER OF CLAIMS
In consideration of being permitted to use the sauna, I, for myself and my heirs, executors, administrators, and assigns, release and hold harmless the Company and its owners, members, employees, contractors, agents, and affiliates from any and all claims arising out of my use of the facilities, including claims for personal injury, illness, death, or property damage — including those arising from ordinary negligence — whether known or unknown, occurring now or in the future, to the fullest extent permitted by law. This release does not apply to gross negligence or willful misconduct.
INDEMNIFICATION
I agree to indemnify and hold harmless the Company from claims, damages, or expenses (including attorney fees) arising from my conduct, participation, guests, or violation of this agreement.
EMERGENCY CARE
I authorize Ogden Valley Sauna LLC to contact emergency medical services if necessary and understand I am responsible for all resulting medical expenses.
SEVERABILITY
If any provision of this waiver is found invalid, the remaining provisions remain in effect.
GOVERNING LAW
This agreement is governed by Utah law.
DISPUTE RESOLUTION / MEDIATION
The parties will first attempt mediation with a neutral mediator in Utah (or, if they cannot agree, a mediator appointed by a recognized mediation provider). Costs will be shared equally and parties will participate in good faith.
If mediation does not resolve the dispute, any action shall be brought exclusively in the state or federal courts located in Utah, and, to the fullest extent permitted by law, the parties knowingly and voluntarily waive any right to a jury trial.
ACKNOWLEDGMENT
I acknowledge that I have read this waiver in its entirety, understand its terms, and agree to them freely and voluntarily.
